NOTICE OF SPECIALHEARING—AREA VARIANCE
PleaseTake Notice that a specialhearing will be held by the Town of Stephentown Zoning Board of Appeals “ZBA” on the 22nd day of May, 2013, at 7:00o'clock p.m. at Town Hall, 26 Grange Hall Road, Stephentown, New York 12168at which time a vote will take place on the application to the Zoning Board ofAppeals by Howard Commander dated February 6, 2013 which seeks an area varianceto allow the placement and construction of a 16 foot high berm/fence (1o footberm: 6 foot fence) in connection with Commander’s proposed moto-cross track onthe eastern edge of property located at tax map # 224.-1-8.1, street address of134 Webster Hill Road (located on land adjacent to the existing drag strip) andis owned by Howard Commander and is located adjacent to the existing dragstrip. An area variance is neededbecause the subject property does not have the requisite minimum 25’ setback asrequired in an R-1 Residential District as set forth in Article IV of the TownLand Use Regulations. PleaseTake Notice that a special hearingwill be held by the Town of Stephentown Zoning Board of Appeals “ZBA” on the 22nd day of May, 2013, at 7:00 o'clock p.m.at Town Hall, 26 Grange Hall Road, Stephentown, New York 12168 at which a votewill take place on the application to the Zoning Board of Appeals by HowardCommander dated October 7, 2010, as amended which seeks a use variance to allow the placement and operation of amoto-cross track on the property located at tax map # 224.-1-8.1, streetaddress of 134 Webster Hill Road (located on land adjacent to the existing dragstrip). Said property is located in a R-1 district and is owned by HowardCommander. An use variance is neededbecause said usage is not allowed in that zone without a use variance per theTown Land Use Regulations.
